Privacy Policy

Yellow and Black Electrical Pty Ltd (ACN 669852635) as trustee for the Gauci Family Trust, trading as Mysparkiepal ("Mysparkiepal", "we", "us") respects your privacy. This Privacy Policy explains what personal information we collect when you use Mysparkiepal (the "App"), how we use it, who we share it with, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs").

1. Information we collect

We collect personal information in the following ways:

Information you give us directly
• Email address (for sign-in via one-time code)
• Name (optional, for personalisation and certificates)
• Business name and electrical licence number (optional, for CES forms and reports)
• Licence Wallet records — licence type, number, state, expiry, and photos of your licence cards (optional, for the wallet and renewal reminders)
• State / territory and trade focus (for tailoring compliance answers)
• Phone number (optional — and, only if you tick the box at signup, consent to occasional marketing SMS; we record what you agreed to and when)
• Photos, plans, and documents you upload to jobs or for audit
• Meeting and voice recordings you choose to record, and their transcripts
• Job records you create — which may include your customers' names, addresses, and phone numbers (see "Your customers' information" below)
• Job descriptions, materials queries, and chat messages with the AI
• Messages in job and crew chats with your team
• Posts and replies in the Community Hub

Information we collect automatically
• Approximate location (when you use the nearest-wholesaler feature, and only with your permission)
• Feature usage counts (for tier metering and quality improvement)
• Device type and OS version (for compatibility diagnostics)
• IP address (logged at request level for security)

Information from third parties
• For in-app subscriptions, Apple / RevenueCat send us your subscription status (we never see your card details).
• For any business/web-billed plans, Stripe sends us subscription status and the last 4 card digits (we never see full card numbers).

Your customers' information
When you store a job, quote, certificate, or meeting, you may include personal information about YOUR customers (names, site addresses, phone numbers). You're responsible for having the right to record that information and for handling it in line with your own privacy obligations. We process it only to provide the App's features to you, we don't use it for marketing, and it's deleted with your account under clause 6.

2. How we use your information

We use the information we collect to:
• provide and personalise the App's features (state-aware answers, tailored materials);
• run AI-assisted features (we send your query, photo, or job description to our AI providers — see clause 4);
• meter usage against your subscription tier;
• process subscription payments via Stripe;
• send transactional emails (sign-in codes, receipts, important account notices);
• send occasional SMS about deals and offers ONLY if you gave explicit consent at signup — opt out anytime by replying STOP or emailing us, and we stop immediately;
• diagnose issues, prevent abuse, and improve the App's accuracy over time;
• comply with our legal obligations.

We do not sell your personal information. Ever.

3. AI training — what we do and don't do

We use anonymised patterns from queries and audit feedback to improve Mysparkiepal's prompts and direct-lookup library. Anonymised means: we strip identifiers (your user ID, email, name, location, business) so the resulting signal is "for queries about RCD protection, our audit AI was corrected X times in this way". Your identifiable photos, business data, and individual query history are NEVER used to train external AI models.

4. Third-party processors

To deliver the App we share specific data with these processors. We have data-processing arrangements with each. They process data on our instructions and may not use it for their own purposes.

Meeting and voice recordings are transcribed on OUR OWN infrastructure (a local speech-to-text model) — your audio is not sent to any third-party transcription service.

Our AI providers (Google, Anthropic) process your queries, photos and audio solely to generate your result. Under their API terms, this data is NOT used to train their models and is NOT sold.

5. Where your information is stored

Most of our infrastructure and your data are hosted on servers operated by the processors above, which are predominantly located in the United States. Your jobs, photos, plans and account data are stored on our application host (Railway) in a United States region; authentication is handled by Supabase. We may move primary data storage to an Australian region in future; this Policy will be updated if we do.

Sending personal information overseas is a "cross-border disclosure" under APP 8. Where we do this, we ensure either (a) the recipient is subject to enforceable privacy obligations substantially similar to the APPs, or (b) you've consented. By using the App you consent to this cross-border processing.

We take reasonable steps to protect your personal information:
• all data in transit is encrypted via HTTPS / TLS;
• passwords aren't used (sign-in is by one-time email code);
• access to production systems is restricted to a small team and logged;
• secrets are stored in OS-level keychains, not in source code;
• we follow least-privilege principles for processor access.

No method of transmission or storage is 100% secure. If we ever experience a data breach that's likely to result in serious harm to you, we'll notify you and the Office of the Australian Information Commissioner (OAIC) in line with the Notifiable Data Breaches scheme.

8. Your rights

Under the APPs you have the right to:
• access the personal information we hold about you;
• correct it if it's wrong;
• request deletion (subject to legal retention obligations);
• complain about how we've handled it.

9. Children

Mysparkiepal is built for working sparkies and apprentices and is not directed at children under 16. We don't knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact us at admin@mysparkiepal.com and we'll delete it.

10. Cookies and similar technologies

The Mysparkiepal mobile app uses on-device storage (AsyncStorage) to remember your sign-in session, theme, and toolbar layout. It does not use third-party advertising cookies, behavioural tracking pixels, or cross-app identifiers.

11. Changes to this Policy

We may update this Privacy Policy. For material changes, we'll notify you in-app and by email at least 30 days before the change takes effect. The "last updated" date at the bottom shows when this version came into force.
