These Terms of Use ("Terms") govern your access to and use of Mysparkiepal (the "App"), operated by Yellow and Black Electrical Pty Ltd (ACN 669852635) as trustee for the Gauci Family Trust, trading as Mysparkiepal ("Mysparkiepal", "we", "us", "our"). By creating an account or using the App you agree to these Terms. If you don't agree, don't use the App.
Mysparkiepal is built for licensed electrical contractors, apprentices, and trade students operating in Australia. You must be at least 16 years old and hold (or be training toward) the appropriate electrical credentials for the work you do. You represent that the information you give us when signing up is true and that you're authorised to enter into these Terms.
If you are an apprentice or otherwise not yet licensed: you can use Mysparkiepal as a learning and reference tool, but you cannot lawfully energise, test, certify, or sign off electrical work in your own right. Any work you carry out must be performed under the direct supervision of a licensed electrician in accordance with the apprenticeship and licensing requirements of your state or territory. The licensed supervisor is the person responsible for certifying that work — not Mysparkiepal, and not you as the apprentice user of this App.
You're responsible for everything that happens under your account, including keeping your login email secure and not sharing access. Notify us immediately at admin@mysparkiepal.com if you suspect unauthorised access. We may suspend or terminate your account if you breach these Terms or use the App in a way that puts other users or our infrastructure at risk.
Mysparkiepal uses artificial intelligence to generate compliance guidance, photo audits, materials lists, fault diagnostics, and similar outputs. All AI output from Mysparkiepal is provided as guidance only — it is NOT professional advice, NOT a certification of compliance, and NOT a substitute for the judgment of a licensed electrician.
You must independently verify all output against:
• the current AS/NZS Standards (especially AS/NZS 3000 and AS/NZS 3008);
• the regulations and licensing requirements of the state or territory you're working in;
• the manufacturer's instructions for the equipment you're installing or commissioning; and
• your own training, experience, and licensed-electrician judgment.
Responsibility for the work
Mysparkiepal does not perform, supervise, certify, or assume responsibility for any electrical work. Responsibility for ensuring that any electrical work complies with the applicable Standards, regulations, and licensing requirements rests with the licensed electrician who performs, supervises, or signs off the work — not with Mysparkiepal.
Where you are a licensed electrician using the App, you are that responsible person. Where you are an apprentice or unlicensed user, the licensed electrician supervising your work is the responsible person — by using the App in this capacity you confirm that you are working under qualified supervision and that the supervisor (not Mysparkiepal) is making the final compliance and safety determinations.
AI output can be wrong, out of date, or misapply context. Energising, testing, signing off, or certifying any electrical installation based on Mysparkiepal output alone — without independent professional verification — is not the App's intended use. If something looks wrong, it probably is.
Mysparkiepal references and summarises Australian/New Zealand Standards (including AS/NZS 3000 and AS/NZS 3008) for educational and guidance purposes. The Standards themselves remain the copyright of Standards Australia / Standards New Zealand. Our summaries are paraphrased explanations, not reproductions of clause text, and do not replace your obligation to consult the current published Standards for compliance work.
The App, its code, its trade-card content library, its UI, brand marks ("Mysparkiepal"), and the proprietary parts of our AI prompts are owned by us. You get a limited, non-exclusive, non-transferable licence to use them inside the App for your own electrical work. You don't get rights to copy, redistribute, resell, scrape, or use Mysparkiepal content to train competing AI systems.
When you upload photos for audit, post a job to the Community Hub, ask a question, or otherwise submit content, you grant us a non-exclusive, royalty-free licence to host, process, and display that content to deliver the service to you. We may use anonymised, aggregated patterns from queries and audits to improve the App's AI — never in a way that identifies you, your customers, or your sites.
You confirm that:
• you have the right to share what you upload (site photos shouldn't contain identifiable third parties or confidential property markings without permission);
• you won't upload content that's illegal, defamatory, infringing, or designed to harm others.
We can remove content that breaches these Terms. We don't pre-moderate community posts.
You agree not to:
• use the App for any illegal purpose;
• attempt to break, bypass, or stress-test our security or rate limits;
• impersonate another sparky, business, or regulator;
• use bots or automated agents to query the App outside its intended interface;
• resell access to the App or share your account credentials commercially;
• use the App's output to provide compliance certification services to a third party without their direct involvement.
Mysparkiepal relies on third-party services to function (see our Privacy Policy for the full list). Their availability, terms, and pricing are outside our control. We don't accept liability for failures or outages caused by these providers, though we'll work in good faith to restore service when they happen.
Mysparkiepal offers free and paid tiers. The specific terms applicable to paid plans — including auto-renewal, billing, cancellation, and refunds — are set out in our Subscription Terms, which form part of these Terms.
You can stop using Mysparkiepal any time. You can delete your account from Settings → Profile or by emailing admin@mysparkiepal.com. We can suspend or terminate your access if you materially breach these Terms, if your use puts our infrastructure or other users at risk, or if we're required to do so by law. Where the breach is curable, we'll give you reasonable notice and a chance to remedy it first. On termination, your right to use the App ends; the survival clauses (IP, liability, indemnity, dispute resolution) continue.
Nothing in these Terms excludes, restricts, or modifies any consumer rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded. If a guarantee under the ACL applies and we breach it, our liability is limited (where the law allows) to:
• re-supplying the relevant service or paying the cost of re-supply, for service breaches; and
• replacement or refund, for any goods supplied.
Subject to clause 10 and to any liability we can't lawfully exclude:
You agree to indemnify us against any third-party claim, loss, or expense (including reasonable legal costs) arising from:
• your breach of these Terms;
• content you submit to the App that infringes a third party's rights;
• your reliance on AI output without the independent verification clause 3 requires; and
• your provision of electrical services that don't comply with the applicable Standards or licensing regime, regardless of any AI output involved.
Our Privacy Policy explains what we collect, how we use it, who we share it with, where it's stored, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles. It forms part of these Terms.
We may update these Terms. For material changes, we'll notify you in-app and by email at least 30 days before the change takes effect. Your continued use of the App after the change date confirms you accept the updated Terms. If you don't accept, you can cancel your subscription and stop using the App before the change takes effect.
These Terms are governed by the laws of Victoria, Australia. Disputes that aren't resolved by good-faith negotiation may be brought in the courts of Victoria, Australia. Nothing in this clause prevents us from seeking injunctive relief in another jurisdiction where required to protect our IP or infrastructure.
